Mediation has become essential in addressing conflicts that litigation often fails to resolve, particularly in families, communities, and faith-based institutions. Rising cases of divorce, domestic violence, property disputes, and church conflicts call for solutions that emphasize dialogue, restoration, and peace. In Kenya, Article 159 (2)(c) of the Constitution and Section 64 of the Marriage Act 2014 affirm mediation’s validity, with courts adopting it to ease backlog.
Court-annexed or voluntary mediation is affordable, timely, and tailored to disputants’ needs, creating demand for trained mediators. To meet this need, ANU offers a 50-hour Professional
Mediation Course, combining classroom and e-learning, aligned with MAC standards, and awarding certification upon completion.
Course Description
This course provides a comprehensive introduction to mediation within Alternative Dispute Resolution (ADR). It equips participants with an understanding of conflict foundations, Dispute
Resolution Mechanisms (DRMs), and the legal framework of mediation. Learners gain practical skills with emphasis on ethics and professional standards aligned to national and international
norms. Advanced modules such as court-annexed mediation prepare participants for judicial and quasi-judicial contexts. The course also explores culture, power, and gender dynamics in
mediation, while offering guidance on establishing professional mediation practice, compliance, accreditation, and career development, enabling participants to engage effectively in real-world
dispute resolution.
Intended Learning Outcomes
Upon successful completion of this course, participants will be able to:
1.Demonstrate a comprehensive understanding of the nature, sources, and dynamics of conflict, and articulate the role of mediation within the broader spectrum of Dispute Resolution Mechanisms (DRMs).
2.Develop and apply core mediation skills and strategies to facilitate effective and sustainable dispute resolution outcomes.
3.Interpret and adhere to ethical and professional standards governing the conduct of mediators, in alignment with national and international best practices.
4.Critically assess and respond to cultural, power, and gender considerations that influence mediation processes and outcomes.
5.Identify and evaluate opportunities for professional mediation practice in diverse contexts—including court-annexed mediation—and implement practical strategies for
establishing and sustaining a successful mediation practice.

∙The participants shall be awarded 3 certificates inclusive of a Professional Mediation and Reconciliation certificate, transcript, and letter of recognition to enable them to apply to the Mediation Accreditation Committee or for private meditation.

ASSESSMENT AND CERTIFICATION:
A combination of exams, assignments, role-playing activities, comprising a mock mediation case will be used to evaluate participants. A Professional Mediation and Reconciliation certification,
which attests to the participant’s competence in resolving disputes and supporting reconciliation
in a variety of situations, will be awarded upon successful completion of the course.
